Valuation disagreements occur in many venues; from litigations in Partnerships, Breach of Contracts, Eminent domain and Condemnation takings (Land Acquisition Cases), Rent Control Act (Mesne Profit Computations).

BMCL’s litigation support experience runs the entire gamut from sale/purchase negotiations, arbitration hearings, to courtroom settings.   • Land Acquisition Cases: The government, under the Land Acquisition Act, has the right to expropriate private property for public use. The payment of just compensation for the acquired land is assured under constitutional guarantee.

    The right to such payments is not questioned but the amount of payments due and the valuation procedure on which such payments are based has always been the cause of disagreement.
    At BMCL we regularly serve our clients in preparing Valuation Report for Land Acquisition. Our Principal Appraisers also provided expert witness testimony as a part of our client’s case in these matters.

     
  • Mesne Profit: As per the amended Rent Control Act (The Maharashtra Rent Control Act 1999) which came into effect from 31st March 2000, certain categories of lessee/ tenants viz. Banks ad Public Sector Undertakings, Corporation established under Central or State Governments, Companies with Paid up capital of more than One Crore etc have been exempt from the purview of the Act.

    At BMCL we regularly provide valuation of such suit properties for computation of the Mesne profit for the period from the date of termination of the Tenancy to the actual handing over of the Property. Thee Reports are invariably challenged and our Principal Valuers appear before the relevant Courts to give Expert Witness testimony
